This website, https://www.analyticconfidence.com, and our course and community platform, https://www.analyticarchive.com, are owned and operated by Analytic Confidence LLC, a Delaware limited liability company (“Company”, “we”, “us”, or “our”).

PROGRAM STRUCTURE AND ENTITY DISCLOSURE

All programs and services are delivered by internal divisions of Analytic Confidence LLC. While these programs may have their own branding, websites, or communication channels, they are not separate legal entities. Analytic Confidence LLC is the sole provider and responsible party for all services and transactions unless otherwise specified.

Payments, customer communications, and service delivery are handled directly by Analytic Confidence LLC via designated tools including Podia, Jotform, Stripe, and Kit.

All sales are processed by Analytic Confidence LLC. Unless explicitly stated, all purchases are final and non-refundable.

We are not liable for service interruptions, outages, or data issues caused by these platforms.

SERVICE AVAILABILITY

We reserve the right to update, pause, or discontinue any product, course, or service at any time. We do not guarantee uninterrupted access.

DISCLAIMER OF WARRANTIES

All content and services are provided “as is” without any warranties, express or implied. This includes, but is not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

LIMITATION OF LIABILITY

To the fullest extent permitted by law, Analytic Confidence LLC is not liable for:

• Indirect, incidental, special, or consequential damages
• Data loss, loss of profits, or business interruption
• Issues caused by third-party platforms or tools

Our total liability is limited to $100, or the amount you paid in the past three months, whichever is lesser.

INDEMNIFICATION

You agree to indemnify and hold harmless Analytic Confidence LLC and its affiliated programs from any claims, damages, or legal costs arising from your use of the website or services, your violation of these Terms, or your infringement of intellectual property or third-party rights.

BINDING ARBITRATION

Any dispute or claim shall be resolved exclusively through binding arbitration in Fort Lauderdale, Florida, under the rules of the International Chamber of Commerce (ICC). You waive the right to participate in class actions or joint legal proceedings. Claims must be brought individually.

GOVERNING LAW

These Terms are governed by and interpreted under the laws of the State of Florida, without regard to conflict-of-law principles.

MODIFICATIONS

HOW WE USE YOUR INFORMATION

THE INTEGRATED SYSTEMS DIAGNOSTIC AND OPTIONAL RESEARCH USE

When you take the Integrated Systems Diagnostic, we collect your answers and your email address through Jotform. Your answers are scored automatically, and your report is emailed to you. We keep a copy of your report so we can support you and answer questions about your results.

We store your diagnostic answers in a secure database without your name or email address. Instead, we create a coded identifier from your email address. This lets us connect a later diagnostic you take, such as at the end of a program, to your earlier one, so we can measure change over time.

At the end of the diagnostic, you may choose to let us use your answers for research. This choice is optional and is never required to receive your report or any of our services. If you consent:

• Your answers may be included in research about how people’s results change over time
• Research results are reported only in aggregate, combined with other participants, and never in a way that identifies you
• Aggregate results may appear in our publications or be shared with educational partners that offer our programs

If you do not consent, your answers are used only to deliver your results and support your participation, and are never included in research. You may withdraw your consent at any time by emailing support@analyticconfidence.com, and we will remove your answers from future research. Aggregate results already published cannot be withdrawn.

AI-ASSISTED REVIEW OF PROGRAM SUBMISSIONS

Participants in our programs may be asked to complete short forms before live sessions, such as pre-call check-ins. We review these responses to plan each session. We may use AI tools to help identify common themes across responses so that each session covers what matters most to the group.

When we use AI tools for this purpose:

• We remove names from responses before they are reviewed with AI tools
• We use the responses only to plan and deliver your program
• Responses are never shared with other participants in a way that identifies you
• Responses are not added to any research dataset

Please describe your situation in general terms and leave out names, account numbers, medical diagnoses, and anything you would not want shared.

COOKIES AND TRACKING TECHNOLOGIES

We use cookies, pixels, and similar technologies to monitor website performance and visitor behavior, track marketing campaigns and email engagement, enhance website functionality, and deliver relevant content. You can manage cookie settings through your browser.

HOW WE SHARE INFORMATION

We only share personal data as necessary to operate our website and deliver our services. This may include:
